HCA ZONING

Please Be Aware HC is zoned RE-5 and R-1. RE-5 is Polk County zoning and R-1 is Tryon City Zoning.

In the RE-5 Zoning, Short Term Rental is defined as 90 Days or longer. Rentals less than 90 days are not allowed in RE-5 by Polk County Zoning laws.  

RE-5 does not permit a business.

RE-5 Zoning and A-1 does not permit Bed & Breakfast establishments, under any condition.  Does not permit short term vacation rentals, Air B&B, B&B.

RE-5 Zoning does not permit events, shows, festivals. (FENCE is exception)

RE-5 Zoning does not permit multi-family residences. (ie: Condo's)

RE-5 Zoning does not permit recreational facilities, nature centers, equestrian courses, etc.  (FENCE is exception)

RE-5 Zoning does not permit RV (Recreational Vehicles) except as follows: “One per parcel while stored upon the owner's property on which there is a residence built and utilized for the owner's personal use.”

HCA Recent Zoning Accomplishments to Protect the Hunting Country

A Major Property was purchased by an NC eastern development company in HC with plans to make it a wedding venue, music venue, rental home.  The HCA acted quickly and stopped this concept, with the developer selling to residents who now call it home.

Stopped "Cluster Home" development on New Market Road.  A Miami Developer was going to build cluster homes on New Market.  This would have had long range potential for the Old Block House and the Dearden properties.  The HCA again acted quickly over an 8 month period and the developer dropped the project and went back to Miami.

In May of 2025, there was a challenge to our "short term vacation rental" zoning.  With the support of residents, once again, the HCA blocked this challenge.  The Polk Planning Board voted 5-0 against this applicant and Commissioners voted 4-1 against this.
